The case is about Sanjay Kapur’s children from the first marriage with actor Karishma Kapoor and his third wife, Priya Kapur who have presented the will in the favour of her. Allegation by Karishma Kapoor’s Children
The children in the court assert that Sanjay Kapur in his lifetime never mentioned about the will nor in private conversations and after the death his third wife Priya Kapur delayed showing the concerned documents and the documents which she has produced is unregistered and raises the concern under the Indian Wills Law. They alleged about the forgery of the document and added to this they demanded a full inventory of all movable and immovable assets, asserting their legal heir’s entitlement under the Hindu Succession laws.
Defence by Priya Kapur
Priya Kapur maintain the stand that the will is valid even thought it is unregistered and its was contended in month of March,2025 with witnesses and also shared the chats between her and Sanjay Kapur about the will addon to this she also stated that the children have already given ₹1,900 Crore via trust and they are not completely excluded also the allegations of forgery is baseless.
Delhi High Court Order
The Delhi High Court presided by Justice Jyoti Singh has taken some interim measures. A formal suit has been filed and asked Priya Kapur to file a reply within 2 weeks and children to follow with rejoinders. There is a possibility of interim injunction and possibly freezing of assets to prevent misuse till the final decision.
Conclusion
The case of inheritance becomes the spotlight around the nation and pits the rights of children under Indian Inheritance Law against the claim by the surviving spouse which is also on the hinge of the authenticity and legal validity. This case will influence the upcoming high value inheritance-based cases in India especially when there is no registration of the will and protection of legal heirs.
